Editor’s Note: The following letter is the text of a full-page advertisement published in The Hill on July 23, 2026. On July 22, one day before the advertisement appeared, former Ambassador Morse Tan was informed by his attorney that a South Korean court had issued a third order barring him from leaving the country through August 15. The travel ban was disclosed six days after prosecutors indicted former Ambassador Tan. Although South Korean courts generally notify defendants of such orders by text message shortly after an indictment, former Ambassador Tan did not receive such a notification.

Let Ambassador Morse Tan Come Home

Answer him with facts. Do not trap him with an exit ban –

Mr. President, Mr. Secretary:

A former Senate-confirmed U.S. Ambassador-at-Large is being prevented from returning to the United States from the Republic of Korea, one of America’s closest allies. He has not been accused of violence, espionage, or any threat to public safety. This is a speech case, not a security case. It now raises urgent questions of jurisdiction, free expression, and due process.

Ambassador Morse H. Tan served the United States as Ambassador-at-Large for Global Criminal Justice, advancing accountability for genocide, war crimes, crimes against humanity, and other grave human-rights violations. A Korean-American legal scholar and founding professor of Handong International Law School, he has long cared about Korea, the U.S.-ROK alliance, and the rule of law.
His concern is not hostility.

According to public reports, Korean authorities have placed Ambassador Tan under an exit restriction in connection with a defamation investigation arising from disputed political speech, including statements reportedly made in the United States. A U.S. ally should not use an exit ban to pressure a U.S. citizen over political speech on U.S. soil without a clear legal basis and full due process.

The speech at issue concerns public affairs and implicates constitutional and international free expression principles. Ambassador Tan and his counsel have also raised due-process concerns about notice and procedure in Korea.

On July 16, President Trump made foreign election interference and vulnerabilities in election systems a major U.S. concern. In South Korea, many citizens, especially younger voters, have called for greater election transparency, hand-counting safeguards, and reforms to protect meaningful political participation. Ambassador Tan’s advocacy belongs in that democratic debate. It should not make him a target.

Defamation law has a proper place in any legal system. But in a democracy, it must not become a muzzle for public debate, election-integrity inquiry, international observation, or criticism of powerful officials. If Korean authorities dispute Ambassador Tan’s statements, they can present facts, release records, and respond publicly. Democracies answer contested speech with evidence, not travel restraints.

An exit ban answers nothing. It restricts freedom of movement while disputed facts remain unresolved. It also risks chilling election observers, scholars, journalists, and citizens who believe free nations must be able to ask how votes are cast, counted, and certified.

The alliance between the American and Korean peoples remains strong. It should not be strained by an unnecessary and disproportionate restriction in a politically charged speech case. Any disputed claim can be answered through facts, records, counsel, and appropriate diplomatic channels. It does not require keeping Ambassador Tan from returning to the United States.

We respectfully urge President Donald J. Trump, Secretary of State Marco Rubio, the U.S. Embassy in Seoul, and members of Congress to act without delay:

  1. Press the Republic of Korea to lift Ambassador Tan’s exit restriction immediately and allow him to return freely to the United States.
  2. Make clear to Seoul that restricting a former U.S. Ambassador-at-Large’s return over U.S.-based political speech unrelated to violence or national security is a serious alliance concern.
  3. Urge Korean authorities to answer disputed public claims with evidence, records, and due process, not legal pressure or travel restraint.
  4. Defend election-integrity inquiry, international observation, and political speech as legitimate democratic activity, not grounds for retaliation.

This appeal is not an attack on South Korea. It is a plea to defend the freedom, rule of law, and mutual trust on which the U.S.-ROK alliance rests.

Ambassador Tan’s work has been lawful, public, and grounded in democratic concern. If Korean authorities believe he is wrong, they can answer with facts and records. They should not use an exit ban to keep him from returning to his own country.

명예훼손법은 어느 법체계에서든 필요할 수 있습니다. 그러나 민주주의 국가에서 그 법이 공적 논쟁, 선거 공정성에 대한 문제 제기, 국제적 선거 감시, 권력자에 대한 비판을 막는 수단이 되어서는 안 됩니다.

탄 대사의 발언에 이의가 있다면 사실을 제시하면 됩니다. 기록을 공개하면 됩니다. 공개적으로 반박하면 됩니다. 민주주의는 논쟁적 발언에 대해 증거로 답해야지, 출국정지로 답해서는 안 됩니다.

출국정지는 아무것도 해명하지 못합니다. 다투어지는 사실관계는 그대로 둔 채, 한 사람의 이동의 자유만 제한할 뿐입니다. 또한 선거감시자와 학자, 언론인, 그리고
선거의 절차와 결과에 대해 질문할 수 있어야 한다고 믿는 시민들에게 부당한 압박으로 받아들여질 수 있습니다.

미국 국민과 한국 국민 사이의 동맹은 여전히 굳건합니다. 한미동맹은 자유, 법치, 인간의 존엄, 민주주의에 대한 공동의 약속 위에 서 있습니다. 정치적으로 민감한 표현 사안에서 과도한 출국정지 조치로 그 신뢰가 훼손되어서는 안 됩니다.

따라서 우리는 도널드 J. 트럼프 대통령님, 마코 루비오 국무장관님, 주한 미국대사관, 그리고 미 의회 의원들께 지체 없이 다음 조치에 나서 주실 것을 정중히 요청드립니다.

  1. 대한민국 정부가 탄 대사에 대한 출국정지를 즉각 해제하고, 그가 자유롭게 미국으로 돌아갈 수 있도록 촉구해 주십시오.
  2. 폭력이나 국가안보와 무관한 미국 내 정치적 발언을 이유로 전직 미국 국무부 대사급 인사의 귀국을 제한하는 것은 중대한 동맹 현안임을 한국 정부에 분명히
    전달해 주십시오.
  3. 한국 당국이 논쟁적 공적 주장에 대해 법적 압박이나 출국 제한이 아니라, 증거와 기록, 적법절차로 답하도록 촉구해 주십시오.
  4. 선거 공정성에 대한 문제 제기, 국제적 선거 감시, 정치적 표현은 보복의 대상이 아니라 정당한 민주적 활동임을 옹호해 주십시오.

이 호소는 대한민국 정부를 공격하려는 것이 아닙니다. 한미동맹의 토대인 자유, 법치, 상호 신뢰를 지키기 위한 요청입니다.

모스 탄 대사의 활동은 공개적이고 합법적이며, 민주주의에 대한 진지한 우려에 뿌리를 두고 있습니다. 한국 당국이 그가 틀렸다고 믿는다면 사실과 기록으로 입증하면 됩니다.

그러나 출국정지로 그를 자신의 고국으로 돌아가지 못하게 해서는 안 됩니다.
