Mr. President, Mr. Secretary:<\/strong>

A former Senate-confirmed U.S. Ambassador-at-Large is being prevented from returning to the United States from the Republic of Korea, one of America\u2019s closest allies. He has not been accused of violence, espionage, or any threat to public safety. This is a speech case, not a security case. It now raises urgent questions of jurisdiction, free expression, and due process.

Ambassador Morse H. Tan served the United States as Ambassador-at-Large for Global Criminal Justice, advancing accountability for genocide, war crimes, crimes against humanity, and other grave human-rights violations. A Korean-American legal scholar and founding professor of Handong International Law School, he has long cared about Korea, the U.S.-ROK alliance, and the rule of law.
His concern is not hostility.

According to public reports, Korean authorities have placed Ambassador Tan under an exit restriction in connection with a defamation investigation arising from disputed political speech, including statements reportedly made in the United States. A U.S. ally should not use an exit ban to pressure a U.S. citizen over political speech on U.S. soil without a clear legal basis and full due process.

The speech at issue concerns public affairs and implicates constitutional and international free expression principles. Ambassador Tan and his counsel have also raised due-process concerns about notice and procedure in Korea.

On July 16, President Trump made foreign election interference and vulnerabilities in election systems a major U.S. concern. In South Korea, many citizens, especially younger voters, have called for greater election transparency, hand-counting safeguards, and reforms to protect meaningful political participation. Ambassador Tan\u2019s advocacy belongs in that democratic debate. It should not make him a target.

Defamation law has a proper place in any legal system. But in a democracy, it must not become a muzzle for public debate, election-integrity inquiry, international observation, or criticism of powerful officials. If Korean authorities dispute Ambassador Tan\u2019s statements, they can present facts, release records, and respond publicly. Democracies answer contested speech with evidence, not travel restraints.

An exit ban answers nothing. It restricts freedom of movement while disputed facts remain unresolved. It also risks chilling election observers, scholars, journalists, and citizens who believe free nations must be able to ask how votes are cast, counted, and certified.

The alliance between the American and Korean peoples remains strong. It should not be strained by an unnecessary and disproportionate restriction in a politically charged speech case. Any disputed claim can be answered through facts, records, counsel, and appropriate diplomatic channels. It does not require keeping Ambassador Tan from returning to the United States.

We respectfully urge President Donald J. Trump, Secretary of State Marco Rubio, the U.S. Embassy in Seoul, and members of Congress to act without delay:<\/p>\n\n\n\n

  1. Press the Republic of Korea to lift Ambassador Tan\u2019s exit restriction immediately and allow him to return freely to the United States.<\/li>\n\n\n\n
  2. Make clear to Seoul that restricting a former U.S. Ambassador-at-Large\u2019s return over U.S.-based political speech unrelated to violence or national security is a serious alliance concern.<\/li>\n\n\n\n
  3. Urge Korean authorities to answer disputed public claims with evidence, records, and due process, not legal pressure or travel restraint.<\/li>\n\n\n\n
  4. Defend election-integrity inquiry, international observation, and political speech as legitimate democratic activity, not grounds for retaliation.<\/li>\n<\/ol>\n\n\n\n

    This appeal is not an attack on South Korea. It is a plea to defend the freedom, rule of law, and mutual trust on which the U.S.-ROK alliance rests.

    Ambassador Tan\u2019s work has been lawful, public, and grounded in democratic concern. If Korean authorities believe he is wrong, they can answer with facts and records. They should not use an exit ban to keep him from returning to his own country.<\/p>\n\n\n\n
